Do I Need a Living Trust?
Not everyone needs a living trust—but many families benefit significantly from one. A revocable living trust is often recommended if any of the following apply to you:
A living trust allows real estate—your home, rental property, or out-of-state property—to transfer to your heirs without probate.
A trust allows you to control when and how your children receive their inheritance, rather than a lump-sum distribution at age 18. It also provides added protection in blended family situations.
A living trust can provide for the smooth transition or liquidation of a business, helping preserve value and avoid disruption.
A properly designed trust can protect an inheritance without jeopardizing state or federal benefits.
Without a trust, assets titled in your individual name are typically subject to probate.
In Idaho, probate often:
- Takes six months or longer
- Costs $3,000–$10,000 or more
- Becomes a public court process
A living trust can significantly reduce—or eliminate—these burdens.
Estate planning is not one-size-fits-all. Every plan is built around your family, your assets, and your goals.
